Customer Agreement

1. Agreement to Terms
This Customer Agreement (“Agreement”) is a binding contract between you (“Customer”) and Fowler Electrical Contractors, Inc. (“Contractor,” “we,” or “us”), a North Carolina corporation licensed to perform electrical contracting work in the state of North Carolina. By requesting services, signing a work order, or authorizing work to begin, you agree to be bound by this Agreement.
2. Scope of Work
All work performed by Fowler Electrical Contractors, Inc. will be described in a written proposal, estimate, or work order provided to the Customer prior to commencement of work. Any changes to the approved scope of work must be agreed upon in writing via a change order signed by both parties. Verbal authorizations for additional work are not binding on the Contractor.
3. Estimates and Pricing
Written estimates provided by Fowler Electrical Contractors, Inc. are valid for 30 days from the date of issuance unless otherwise noted. Estimates are based on current material costs, labor rates, and permit fees. Final pricing may vary from estimates if unforeseen conditions are discovered during work (e.g., concealed wiring defects, structural obstacles, code violations requiring remediation). The Contractor will notify the Customer of material cost changes before proceeding.
4. Payment Terms
Payment terms are as follows:
- Residential projects under $1,500: Payment in full is due upon project completion.
- Residential projects over $1,500: A deposit of 40% is due before work begins; the remaining balance is due upon completion.
- Commercial projects: Payment schedule will be specified in the project proposal. Typical terms include monthly progress billing.
- Emergency service calls: Payment in full is due at time of service.
We accept payment by check, bank transfer, and all major credit cards. Invoices unpaid after 30 days from the due date are subject to a finance charge of 1.5% per month.
5. Permits and Inspections
Fowler Electrical Contractors, Inc. will obtain all required electrical permits from the appropriate local authority having jurisdiction (AHJ) for work that requires permitting under North Carolina state law. Permit fees are passed to the Customer at cost and will be itemized in the estimate. The Contractor will schedule and facilitate all required inspections. The Customer agrees to provide reasonable access to the premises for inspections.
6. Customer Responsibilities
The Customer agrees to:
- Provide safe and clear access to all areas where work is to be performed
- Disclose any known hazardous conditions at the property, including asbestos, mold, or structural concerns
- Ensure that all utilities are accessible and that the property is ready for work on the agreed start date
- Not modify, alter, or interfere with work in progress without written consent of the Contractor
- Promptly review completed work and notify the Contractor of any deficiencies within 10 business days of project completion
7. Workmanship Warranty
Fowler Electrical Contractors, Inc. warrants all labor and workmanship against defects for a period of two (2) years from the date of project completion. This warranty covers defects in the quality of installation performed by our crews. It does not cover damage caused by misuse, third-party modifications, acts of nature, or normal wear and tear. Manufacturer warranties on materials and equipment are separate from and in addition to this workmanship warranty.
8. Limitation of Liability
In no event shall Fowler Electrical Contractors, Inc. be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to the performance of services, including but not limited to lost profits, loss of use, or damage to third-party property, even if the Contractor has been advised of the possibility of such damages. The Contractor's total liability shall not exceed the total amount paid by the Customer for the specific project giving rise to the claim.
9. Insurance
Fowler Electrical Contractors, Inc. maintains general liability insurance with minimum limits of $1,000,000 per occurrence and $2,000,000 aggregate, as well as workers' compensation insurance as required by North Carolina law. Certificates of insurance are available upon request prior to project commencement.
10. Dispute Resolution
In the event of a dispute arising from this Agreement, the parties agree to first attempt resolution through good-faith written communication. If a dispute cannot be resolved within 30 days, the parties agree to submit to binding arbitration in Moore County, North Carolina, under the rules of the American Arbitration Association. Judgment on any arbitration award may be entered in any court of competent jurisdiction. This Agreement shall be governed by the laws of the State of North Carolina.
11. Cancellation Policy
Scheduled appointments may be cancelled or rescheduled without charge if notice is given at least 24 hours in advance. Cancellations with less than 24 hours' notice may be subject to a service call fee of up to $95 for residential appointments. Project cancellations after work has commenced will be invoiced for all work completed and materials ordered or delivered to the project site.
